1. Acceptance of Terms
These Terms & Conditions (“Terms”) govern access to and use of the Panel Pro software platform (the “Service”), operated by Michael Tucker (“we,” “us,” or “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a business or other organization (an “Organization”), you represent that you have authority to bind that Organization to these Terms.
2. Description of Service
Panel Pro is a project management platform for service businesses, providing tools for managing customers, projects, scheduling, estimates, invoicing, and related communications, including two-way SMS and email messaging with an Organization’s own customers.
3. Accounts and Trials
You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. New Organizations may begin a free trial period, after which continued use of the Service requires an active paid subscription or a valid access code. No payment method is required to start a trial.
4. Acceptable Use
You agree not to use the Service to:
- Send text messages or emails to any individual who has not consented to receive communications from your Organization;
- Send messages containing unlawful, fraudulent, deceptive, harassing, or abusive content;
- Violate any applicable law, including telemarketing and messaging laws;
- Attempt to gain unauthorized access to the Service or any other Organization’s data; or
- Interfere with or disrupt the integrity or performance of the Service.
5. SMS / Text Messaging Terms
Program description. The Service allows an Organization to send and receive text messages with its own customers for purposes related to the services that Organization provides — for example, appointment confirmations and reminders, estimate and project status updates, scheduling coordination, and general customer service.
Consent. An Organization may only text an individual who has provided their mobile phone number to that Organization directly (such as by requesting a quote or scheduling service) or who has texted that Organization’s number first. Consent to receive messages is not a condition of purchasing any goods or services.
Message frequency. Message frequency varies depending on your interactions with the Organization you are communicating with.
Message and data rates. Message and data rates may apply. Check with your mobile carrier for details on your specific plan.
Opt-out. Reply STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message at any time to stop receiving messages from that Organization. You may resume receiving messages by texting that Organization’s number again.
Help. Reply HELP to any message for assistance, or contact us at tech@constantstartup.com.
Carriers. This service is currently supported on major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.
6. Customer Data
As between an Organization and Michael Tucker, the Organization retains all rights to the customer and business data it enters into the Service. We process that data solely to provide the Service to the Organization and in accordance with our Privacy Policy.
7. Intellectual Property
The Service, including its software, design, and branding, is owned by Michael Tucker and is protected by intellectual property laws. Subscribing to the Service grants you a limited, non-exclusive, non-transferable license to use the Service for your business purposes during the term of your subscription.
8. Disclaimers and Limitation of Liability
The Service is provided “as is” without warranties of any kind, express or implied. To the fullest extent permitted by law, Michael Tucker will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
9. Termination
You may cancel your subscription at any time. We may suspend or terminate access to the Service for any account that violates these Terms or fails to maintain an active subscription, with or without notice.
10. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws principles, and any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.
11. Changes to These Terms
We may update these Terms from time to time. We will post any changes on this page and update the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
